New OT rules..

Monday, August 23, 2004

I started to write this as a comment to something that Mac posted on her blog, but it started getting long so I moved it here.

I think before modifications to the new OT rules were made, they would have affected me and Josh.. as they are now, however, I am fairly certain they won’t.  Although I wouldn’t be at all surprised if my company tried to rework our job titles so that they could get away with eliminating our OT.

And as for the low wage workers, from what I understand, if you make $455 or less a week, you are eligble.  Before, it was $155 or less per week, so anyone making more than that (i.e. anyone working minimum wage) was screwed.  I don’t know how they came up with the $155 figure (unless those rules were made when minimum wage was $3/hr), but that means even back when I worked at Blockbuster in ‘93 making $4.25/hr I was inelible for OT.  To be honest, I don’t even remember if I ever got any OT back then.  I know I did once I was making $11.50/hr, but before that… it’s all a blur.

I could be misunderstanding the new rules (and the old ones), but I am fairly sure I am understanding them correctly, especially while at work today at job#2, the manager discussed it briefly with the owner, stating they’re pretty sure it was going to affect their one full-time, non-salaried employee… In other words, that employee will now get OT, when before, she didn’t.  And that full-time employee makes less than the maximum $455/wk set forth in the new rules, which is why she is now eligble.

So anyway, the new rules would also mean, if I ever went full-time at the yarn shop, that I’d also be eligible for OT.

It’s kind of funny, I guess I always just assumed that anyone who worked was eligible for OT unless they were salaried.  I have some of my old pay stubs around here somewhere, so I could technically go back and check them to see if I ever did get any OT before making more than $10/hr… but that would mean cleaning a space on the floor of my office and taking out stacks of boxes from my closet, and I’m not feeling up to doing that right now.

I’d rather knit, or see if I can install PhotoSlop on this here la Powerbook of mine. 😊  ‘cause really, the only purpose it would serve is to satisfy my curiosity, it’s not really all that important since it’s all in the past… As long as the employer for job#1 doesn’t try to twist & tweak things to make it so Josh & I are no longer eligible for OT at our current jobs, I’ll be ok with the rules as they are.
